1. Introduction and Acceptance
By accessing or using Emote, you agree to these Terms and Conditions ("Terms"). If you disagree with any part of these Terms, please do not use our services.
These Terms constitute a legally binding agreement between you and Emote. By creating an account or using our services, you represent that you have read, understood, and agree to be bound by these Terms.
2. Beta Services and Service Availability
You acknowledge that Emote is currently in a Beta phase. The services may contain bugs, errors, or inaccuracies. You understand and agree that:
- The service is provided "AS IS" and "AS AVAILABLE" without any warranties of any kind, express or implied
- We do not guarantee continuous, uninterrupted, or secure access to our services
- Features may change, be removed, or be updated without prior notice
- Service performance may vary and is subject to technical limitations
- We reserve the right to modify, suspend, or discontinue any aspect of the service at any time
3. NOT Medical Advice (Critical Disclaimer)
Emote is an AI-powered emotional companion. It is NOT a doctor, therapist, or licensed mental health professional.
No Diagnosis
The AI cannot and does not diagnose mental health conditions such as depression, anxiety disorders, bipolar disorder, PTSD, or any other medical or psychiatric condition. Any insights provided are for self-reflection purposes only and should never be considered a professional diagnosis.
No Treatment
The conversations provided by Emote are for emotional support, journaling, somatic awareness, and self-reflection purposes only. They do NOT constitute medical advice, psychiatric treatment, psychotherapy, counseling, or any form of professional mental health intervention.
Emergency Situations
If you or someone you know is in immediate danger, experiencing a medical emergency, or having thoughts of self-harm or suicide, STOP using this service immediately and:

4. Age Restrictions and Eligibility
Minimum Age Requirements
You must be at least 13 years old to use Emote. If you are between 13 and 18 years old, you must:
- Have your parent or legal guardian's permission to use Emote
- Have your parent or legal guardian review and accept these Terms on your behalf
- Use Emote under appropriate adult supervision
User Responsibility
By using Emote, you represent and warrant that:
- You are at least 13 years old
- If you are between 13 and 18 years old, you have obtained parental or legal guardian permission
- You have provided truthful and accurate information about your age
- You understand that Emote reserves the right to terminate any account if we believe you have misrepresented your age
Parent/Guardian Responsibility
For users between 13 and 18 years old, the parent or legal guardian:
- Must review these Terms and our Privacy Policy
- Accepts responsibility for the minor's compliance with these Terms
- Accepts responsibility for all activities that occur under the minor's account
- Must ensure appropriate professional mental health care is sought when needed
- Understands that Emote is not a substitute for professional care
5. User Accounts and Security
To use Emote, you must create an account by providing:
- A valid email address
- Any additional personal information as requested
You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Immediately notifying us of any unauthorized use of your account
- Ensuring your account information is accurate and up-to-date
You may not share your account credentials with others or allow others to access your account. We are not liable for any loss or damage arising from your failure to maintain account security.
6. User Conduct and Prohibited Uses
By using Emote, you agree NOT to:
- Use the service for any illegal purpose or in violation of any applicable laws
- Attempt to reverse-engineer, decompile, disassemble, or hack the AI models or backend infrastructure
- Input sensitive personal data such as financial information, government IDs, social security numbers, or detailed health records that are not relevant to emotional wellness conversations
- Harass, abuse, threaten, or harm another person via the platform
- Impersonate any person or entity, or falsely represent your affiliation with any person or entity
- Interfere with or disrupt the functionality, servers, or networks connected to Emote
- Attempt to gain unauthorized access to any portion of the service or any systems or networks
- Use automated scripts, bots, or scrapers to access the service
- Create competing services using our data, models, or intellectual property
- Upload viruses, malware, or any malicious code
- Violate the intellectual property rights of Emote or third parties
Violation of these prohibited uses may result in immediate termination of your account and legal action if applicable.
7. Intellectual Property Rights
The underlying software, algorithms, "Smart Controller" logic, AI models, design, branding, and all content of Emote are the exclusive property of Emote and its founders, protected by copyright, trademark, and other intellectual property laws.
You are granted a limited, non-exclusive, non-transferable, revocable license to use the service for personal, non-commercial use only.
Your Content
You retain ownership of the original content (conversations, inputs) you provide to Emote. However, by using the service, you grant Emote a non-exclusive, worldwide, royalty-free license to use your content for:
- Service delivery and operation
- Service improvement and model training (using anonymized data)
- Research and development
- Quality assurance and safety monitoring
- Analytics and insights generation
Note: Personally identifiable information is removed from data used for model improvement, as detailed in our Privacy Policy.
8. Mandatory Acknowledgments
By using Emote, you explicitly acknowledge and agree that:
Emote is NOT:
- A substitute for professional mental health treatment or therapy
- A crisis intervention service or suicide prevention hotline
- Capable of preventing or treating mental health emergencies
- Staffed by human mental health professionals, therapists, or counselors
- A medical device or medical service of any kind
- Capable of diagnosing or treating any medical or mental health condition
- Monitored in real-time by humans for safety or well-being
You Understand That:
- Emote uses artificial intelligence technology that has inherent limitations
- The AI may provide incorrect, incomplete, inappropriate, or potentially harmful responses
- You use Emote entirely at your own risk
- No specific outcomes, benefits, or improvements are guaranteed
- You are solely responsible for all decisions and actions taken based on interactions with Emote
- Emote cannot and does not monitor for user safety or well-being in real-time
- No human reviews or monitors your conversations in real-time unless for safety flagging or debugging
9. Limitation of Liability and Waiver
Limitation of Liability
To the fullest extent permitted by law, Emote and its founders, employees, contractors, partners, and affiliates shall NOT be liable for any:
- Indirect, incidental, special, consequential, or punitive damages
- Loss of profits, revenue, data, or use
- Emotional distress or mental anguish
- Physical harm or injury
- Damages arising from your use or inability to use the service
- Damages arising from reliance on any information provided by the AI
- Damages arising from unauthorized access to your data
This limitation applies regardless of the legal theory (contract, tort, negligence, strict liability, or otherwise) and even if we have been advised of the possibility of such damages.
Waiver and Release
To the maximum extent permitted by law, you:
- EXPRESSLY WAIVE AND RELEASE Emote from any and all liability, claims, causes of action, damages, costs, or expenses arising from your use of the service
- AGREE TO INDEMNIFY AND HOLD HARMLESS Emote and its affiliates against any claims, damages, or expenses (including legal fees) arising from your violation of these Terms or your use of the service
Maximum Liability
In jurisdictions where liability limitations are restricted, our maximum aggregate liability to you for all claims shall not exceed the amount you paid us (if any) in the twelve (12) months preceding the claim.
10. Subscriptions and Payment
If we offer paid subscription services:
- Payments are processed through trusted third-party payment processors (such as Stripe)
- Payment processing is subject to the payment processor's terms of service and privacy policy
- Subscription fees are billed in advance on a recurring basis
- You authorize us to charge your payment method for all applicable fees

12. Termination
Termination by You
You may terminate your account at any time by following the account deletion process in the application settings or by contacting us at founder@emotenow.app .
Termination by Emote
We may terminate or suspend your access:
- Without prior notice or liability
- For any reason in our sole discretion
- If we believe you violated these Terms
- To comply with law or protect our rights or the rights of others
- For account inactivity or abuse
- For fraudulent or illegal activity
Effect of Termination
Upon termination:
- Your right to use the service immediately ceases
- Your account and data may be deleted according to our data retention policies
- Provisions of these Terms that by their nature should survive termination will survive

We may modify these Terms at any time. When we make material changes, we will:

Any disputes arising from these Terms or your use of Emote shall be subject to the exclusive jurisdiction of the courts located in Chennai, Tamil Nadu, India .
You agree to submit to the personal jurisdiction of these courts and waive any objections based on inconvenient forum.
17. Dispute Resolution
Before filing a lawsuit, you agree to first contact us at founder@emotenow.app to attempt to resolve the dispute informally.
We are committed to resolving disputes in good faith through direct communication whenever possible.
18. Severability and Waiver
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Emote regarding the use of our services and supersede all prior agreements and understandings.
